TECHNICAL-SCIENTIFIC AND REGULATORY POSITION FOR ATYPICAL PESTSTICIDES PRODUCTS

The legal definition of pesticides is quite broad and in it these products are considered as “products and agents of physical, chemical or biological processes, intended for use in the production sectors, in the storage and processing of agricultural products, in pastures, in the protection of forests , native or planted, and other ecosystems and also urban, water and industrial environments, whose purpose is to alter the composition of flora or fauna, in order to preserve them from the harmful action of living beings considered harmful, as well as substances and products used as defoliants, desiccants, growth stimulators and inhibitors”. This definition subjects different products to an often standardized assessment to assess the safety of the representative majority of these substances, products arising from the synthesis of organic chemistry.

The CHALLENGE OF FOOD AND NUTRITIONAL SECURITY highlights the need to prioritize the right to food, expand the understanding of food security, and adopt a comprehensive analytical framework. We must also consider the so-called “DOUBLE BURDEN OF MALNUTRITION,” where undernutrition and obesity coexist within the same society.
The scale of the FOOD AND NUTRITIONAL SECURITY challenge is viewed with pessimism, given the current results falling short of the targets of the 2030 SDG Agenda, particularly SDG 2, which directly addresses the issue of food security for all.

The modernization of legislation presents challenges for public administration to maintain activities such as registration and oversight. This is the case with the new pesticide law, which introduced innovations in several aspects but is interconnected with over 50 subordinate regulations. Understanding how these regulations can interact, using the principle of receptiveness and its antinomies, was the focus of this article. The proposed regulatory transition, which considers the interpretation of each regulation, supports the continuity of the administrative process, avoiding disruptions in one of the most important sectors of agribusiness.

The growing adoption of bioinputs in Brazil highlights a significant transformation in sustainable agriculture, with crucial regulatory and economic implications. This article explores the opportunities and challenges of the new bioinputs legislation, focusing on self-production ("on-farm") and the establishment of an adequate regulatory framework. The authors argue that, despite the absence of detailed regulations, it is vital to ensure the continuity of bioinput production and use. These products are essential for sustainable agricultural practices, and regulation must balance innovation, safety, and large-scale adoption. This article not only contextualizes the legislation but also proposes viable pathways for effectively integrating bioinputs into Brazil's agricultural landscape.
